SIENA AT RENAISSANCE PARK GENERAL RULES & REGULATIONS
Amended: January 23, 2001

I. Decks & Patios

1. Furniture allowable on decks and patios shall include only furniture designed and constructed for exterior patio use. All other furniture types are prohibited.

2. Electric grills for recreational and/or entertainment cooking shall be permitted on the patios and decks provided that the grill is a reasonable size for the patio or deck and the use of the grill does not create a fire hazard. Pursuant to state code 120-3-3-.04(5)(a),Charcoal & gas grills are not permitted.

3. No objects, linen, or clothing shall be attached, hung or made a part of the handrails of the decks and patios. Attractive planters, i.e., no cans or other containers not specifically designed as planters, shall be excepted.

4. No bird feeders shall be hung or placed on the patios.

5. Decks or patios shall not be used for storage of any materials or equipment, including bicycles, not specifically allowed by these rules and regulations. No trash or materials may be disposed of from the patios. Fire wood storage shall be allowed.

II. Pets

1. All pets must be kept on a leash when outside individual units except in designated dog walk areas.

2. Pets cannot be left unattended on the balconies and patios.

3. Pets are not allowed to urinate or defecate specifically in any covered or enclosed areas of common property.

4. All pets should be taken off the property or to the “dog walk” areas provided. If an accident occurs on the way to the dog walk areas or off the property, owners shall be responsible for removing excrement and appropriate cleaning of the affected areas - fines will be enforced.

III. Interior Common Area

1. Residents may not have door mats at the entrance doors of individual units in the common areas.

2. There will be no modifications to the front doors or entrances of individual units in the common areas without prior Board approval.

3. No trash, boxes, furniture, etc. may be placed outside a unit's front door for later placement in the trash. All disposables must be kept inside the individual unit until disposed of in the proper manner.

CLUBHOUSE RULES
Amended: September 28, 1999 

1. Only residents of Siena at Renaissance Park and their guests may use the clubhouse.

2. A homeowner must accompany their guests in the clubhouse at all times.

3. Hours for clubhouse use:

Sunday through Thursday 9am until 12 midnight

Friday and Saturday 9am until 1am

All persons must vacate the clubhouse at time of closing.

4. Occupancy of the clubhouse is limited to 125.

5. No smoking or lighted candles is permitted in the clubhouse.

6. No pets are permitted in the clubhouse at any time.

7. No wet clothing is permitted in the clubhouse.

8. The clubhouse may be reserved for private parties of homeowners and their guests. Reservation of the clubhouse is mandatory for use of the clubhouse by a resident. All reservations must be made with management in writing, a minimum of five (5) days in advance of the date requested. A phone reservation will hold a date for three days. All reservations will be on a first come first served basis.

9. A waiver must be signed by the homeowner and returned to the management company prior to the reserved date.

10. A security deposit of $300 will be deposited and retained in the Clubhouse Account. After inspection by the property management company and no damage to the clubhouse or its related use is found, the $300 deposit will be refunded to the renter.

11. A usage fee of $25.00 will be charged for all reserved uses of the clubhouse. Any function of the Siena at Renaissance Park Condominium Association or the Neighborhood Association will not be charged.

12. A cleaning fee of $25.00 will be charged for all functions in the clubhouse. All trash and garbage generated by the function must be bagged by the renter and disposed in the dumpster behind the building.

13. The pool area and exercise room are open to all homeowners at all times and cannot be reserved.

14. No music from the clubhouse is permitted in the pool area while renting the clubhouse.

15. Delinquent homeowners of 60 days or more cannot reserve the clubhouse.

16. Please be respectful of your neighbors when using the sound system.

POOL RULES
Amended: March 28, 2000

1. There are no set hours for the pool. When using the pool late at night, please be courteous of your neighbors by keeping the noise down.

2. The pool is for the homeowner's use and their guests only. The homeowner/renter must accompany their respective guests at all times.

3. Each unit is allowed no more than four (4) guests per visit.

4. Delinquent homeowners or their renters cannot use the pool facilities.

5. You must abide by all rules posted at the pool.

6. No glass is allowed in the pool area

7. Grills or cook stoves are not allowed.

8. No pets are allowed in the pool or pool courtyard area.

9. Children under the age of twelve (12) will not be allowed in the pool area unless they are accompanied by an adult homeowner 18 years of age or older.

10. Pool area can not be reserved for private use.

11. Each resident/guest must clean up and dispose of any trash generated by him/her, prior to leaving the pool area.

12. Due to the limited number of chairs, no lounges or chairs can be saved. Homeowners can bring their own chairs, but they must be removed each day.

13. Radios, CD players, tape decks, etc., are permitted at a low volume. Earphones must be used if any resident objects.

14. Proper swimwear is required and decent behavior must be adhered to at all times.

EXERCISE ROOM RULES
Amended: March 28, 1996

1. All use of the exercise room is for homeowners at Siena at Renaissance Park Condominium Association and their guests.

2. All guests must be accompanied by a homeowner at all times.

3. Residents must lock all doors upon entering and exiting.

4. Use of exercise room is at your own risk.

5. Residents must keep exercise equipment clean and free of debris.

6. No eating/drinking is permitted in the exercise room.

7. Shirts and proper exercise attire must be worn while exercising.

8. Residents shall not move/remove any exercise equipment.

9. Radios, CD players, tape decks, etc., are permitted at a low volume. Ear phones must be used if any resident objects.

10. Setting of the thermostat must be adhered to by the notice posted at the thermostat.

11. Delinquent homeowners cannot use the exercise facilities.

Parking Areas
Amended: March 28, 2000

1. Parking in any area not specifically marked for parking is prohibited. Any improperly parked vehicle will be subject to towing without notice at the owner's expense. An access requirement of 20 feet is required by the Fire Department in the event of an emergency.

2. Guest parking shall be permitted provided that guests are instructed to park in the designated guest spaces. Residents are responsible for directing their guests to the guest parking areas. Due to limited parking in Phase II and Phase III, any residents holding an organized function must require all guests to park along Renaissance Parkway. Only two (2) guests vehicles may be parked inside the gated property at any time.

3. All car washing on the property shall be done in the areas adjacent to hose bibs.

4. Parking is not permitted in the Phase II & III driveway - 30 minute loading and unloading is permitted in the cobblestone area only.

5. Parking is not permitted in areas that do not allow access to dumpsters by the trash pick up vehicles.

6. No vehicles may be parked or placed upon the property in a condition that may cause the property to look unsightly or cause an unsightly residue or damage from leakage. All vehicles parked on the property must be in running order and not in a condition that may be deemed as being stored such as flat tires, missing wheels, broken windows, etc.

7. No materials, goods or equipment, except for passenger vehicles, may be placed in any parking space.

8. No unlicensed motorized vehicles may be operated on the property. All vehicles must be licensed for street worthiness. (Exception will be any construction or maintenance vehicles as authorized by the Board of Directors or the property management company) All operators of any vehicles must be duly licensed.

Moving
Amended: January 23, 2001
MOVE-IN/MOVE-OUT AND DELIVERY REGULATIONS

1. A move-in / move-out fee of $150.00 will be charged each time an occupant moves into or out of the unit. The move-in / move-out fee shall be paid by the record owner within ten(10) days of the Move. The move-in / move-out fee has been adopted to defray administrative costs and other expenses incurred by the Association when occupants move into or out of the building.

2. The unit owner shall provide the Property Manager with written notice of each move-in or move-out at least five(5) days prior to the move. Such notice shall include the following information:
A. The name, address and telephone number of the unit owner.

•  The name, address and telephone number of the person(s) moving into or out of the unit, if different than (A).

•  The name, address and telephone number of the moving company, if any; and

•  The date and approximate time of the move-in / move-out.

3. Move-ins and move-outs are permitted Monday thru Friday 8:00a.m. – 8:00p.m. No moves are permitted on Saturday or Sunday.

4. Deliveries are permitted Monday thru Saturday 8:00a.m. – 8:00p.m.

TRASH DISPOSAL PROCEDURES
Amended: March 28, 1996

1. ALL trash must be placed in a tied plastic bag. Medium size bags must be used.

2. No boxes shall be placed in the chute, including pizza boxes.

3. All boxes must be placed in the dumpster outside. NO EXCEPTIONS.

4. If trash chute is full, dispose all trash in dumpsters outside.

5. Should it be necessary to dispose of your trash at early morning or late hours, be considerate to the homeowners living near the trash rooms.

6. No trash bags or boxes may be placed in the trash chute room areas.

RULES & REGULATIONS
Fine Structure
Amended: March 28, 1996

Failure to abide by any rules and regulations set forth in the Declaration of Condominium of Siena at Renaissance Park or the Rules and Regulations adopted by the Board of Directors of Siena at Renaissance Park, will result in a fine up to $25.00 per day for each occurrence and for each additional continuing occurrence, unless the fine structure is specifically identified by the Declaration of Condominium of Siena at Renaissance Park.

SATELLITE DISH RULES AND REGULATIONS

•  General . These rules and regulations apply to the installation, maintenance and use of Satellite Dish Antennas, Wireless Cable Antennas and Television Antennas, as further defined below. Notwithstanding anything within the Condominium Instruments to the contrary, the foregoing Antennas may be installed at the Condominium in accordance with these rules and regulations. No other dish, antenna or other device designed to receive or transmit satellite service, video programming services, wireless signals and/or television broadcast signals shall be erected, used, or maintained on any portion of the Condominium property; provided, however, that the Association shall have the right to erect, construct and maintain such devices. Any installation of the foregoing not in compliance with these rules and regulations may be removed by the Association, at the expense of the Unit Owner, in accordance with the Condominium Instruments.

•  Definitions . For purposes of these rules and regulations, the following terms shall have the meanings set forth below:

•  “Satellite Dish Antenna” shall mean and refer to any antenna that is one (1) meter or less in diameter and is designed to receive direct broadcast satellite service, including direct-to-home satellite service, or to receive or transmit fixed wireless signals via satellite.

•  “Wireless Cable Antenna” shall mean and refer to any antenna that is one (1) meter or less in diameter or diagonal measurement designed to receive video programming services via multi-point distribution services (wireless cable) or to receive or transmit wireless signals other than via satellite.

•  “Television Antenna” shall mean and refer to any antenna that is designed to receive local television broadcast signals.

•  “Antenna” shall mean and refer to any Satellite Dish Antenna, Wireless Cable Antenna or Television Antenna. Any mast, cabling, supports, guide wires, conduits, wiring, fasteners, or other accessories necessary for the proper installation, maintenance, and use of an Antenna shall be considered a part of the Antenna.

•  Antenna Size and Type .

•  The Owners and/or Occupants of each Unit may install no more than one (1) Satellite Dish Antenna, one (1) Wireless Cable Antenna and one (1) Television Antenna in accordance with these rules and regulations. All other antennas, dishes or devices designed to receive or transmit satellite service, video programming services, wireless signals and/or television broadcast signals are prohibited and may not be installed anywhere on the Condominium property.

•  Satellite Dish Antennas which are more than one (1) meter in diameter and Wireless Cable Antennas which are more than one (1) meter in diameter or diagonal measurement are expressly prohibited.

•  Location and Installation of Antennas .

•  Antennas may be installed in the following locations provided the Notice of Antenna Installation form attached hereto as Exhibit “A” is completed and returned to the Association prior to installation:

•  If an acceptable quality signal can be received by placing the Antenna inside a Unit, the Antenna must be installed within the Unit and outdoor installation is prohibited.

•  In those instances where the installation of an Antenna inside a Unit will not result in an acceptable quality signal, the Antenna may be installed on a Unit Owner's or Occupant's patio or balcony designed to exclusively serve the Unit and assigned to such Unit as a Limited Common Element (hereinafter “Exclusive Use Areas”). No Antenna may extend beyond the boundaries of any Exclusive Use Area, including, without limitation, any air space outside the boundaries of the Exclusive Use Area. Any such installation of an Antenna on a patio or balcony shall not convert the Limited Common Element to individual property.

•  Antennas may not be installed on the roof of any building or attached to any exterior building surface or otherwise installed on or attached to any portion of the Common Elements.

•  Antennas must be properly secured so they do not jeopardize the soundness or safety of any structure or the safety of any Owner or Occupant.

•  The exterior surfaces of Exclusive Use Areas may not be penetrated unless such penetration is necessary to receive an acceptable quality signal or if alternate methods of installation would unreasonably increase the cost of installation. If penetration of the exterior surface of Exclusive Use Areas is necessary, the penetration must be properly water-proofed and sealed in accordance with applicable industry standards and building codes.

•  Antennas may not encroach upon any Common Elements, any other Owner's or Occupant's Unit or Limited Common Element.

•  The following devices must be used unless they would prevent an unacceptable quality signal or unreasonably increase the cost of installation, maintenance or use:

•  Devices that permit the transmission of signals through a glass pane without cutting or drilling a hole through the glass pane;

•  Devices, such as ribbing cable, which permit the transmission of signals into a Unit through a window or door without penetrating the wall; and

•  Existing wiring for transmitting telecommunication signals and cable service signals.

•  Antennas must not obstruct access, ingress or egress to or from any Unit or other area necessary for the safe operation of the Condominium.

•  All Antennas must be painted to match the color of the structure to which they are attached.

•  All exterior wiring of Antennas must be installed so as to be minimally visible, wiring must be painted to blend into the material to which it is attached. No wiring or cabling will be allowed on the roof or on any exterior building surface.

•  Antennas shall be installed by qualified persons who are knowledgeable as to Antennas and Antenna installations. Antennas shall be installed and secured in a manner that complies with all applicable local, state and federal laws and regulations, including, but not limited to, all applicable building, fire, electrical and related codes and ordinances.

•  The installation of any Antenna shall be in accordance with the manufacturer's installation specifications and the installer of any Antenna shall have a copy of such specifications on site at all times during installation.

•  Antennas may not be installed in a manner that would result in increased maintenance costs for the Association or other Owners. If increased maintenance occurs, the Owner and Occupant are responsible for all such costs.

•  All costs of installation are the responsibility of the Unit Owner and Occupant.

•  Notice of Antenna Installation . Prior to the installation or attachment of any Antenna as permitted herein, the Unit Owner or Occupant must notify the Association in writing by completing and returning the Notice of Antenna Installation form attached hereto as Exhibit “A.” If the Antenna is installed in a pre-approved location, and in accordance with these rules and regulations, then no further action is required by the Owner or Occupant and the Owner or Occupant may proceed promptly with installation after the Notice of Antenna Installation is filed.

•  Maintenance and Repair of Antennas .

•  Owners and Occupants are required to maintain, repair and replace their installed Antennas in a safe and attractive condition. All costs of maintenance, repair and replacement are the responsibility of the Unit Owner and Occupant. The Owner and Occupant shall be responsible to repaint or replace any Antenna if the exterior surface of said Antenna becomes worn or deteriorated.

•  The Owner and Occupant responsible for the Antenna must reattach the Antenna within forty-eight (48) hours after it becomes dislodged, for any reason, from its original point of installation. If the detachment of any Antenna threatens the safety of a resident, the Association may, without notice, remove the Antenna at the expense of the Owner and Occupant.

•  Removal of Antennas . Upon the removal of any Antenna by an Owner or Occupant, for whatever reason whatsoever, the Owner and Occupant are required to restore the installation location to its original condition.

•  Responsibility for Damage or Injury . The Owner and Occupant are responsible for any and all damage to any property caused by the installation, maintenance or use of any Antenna serving their Unit and are responsible for the payment of all medical expenses incurred by any persons injured by the installation, maintenance or use of the Antenna.

•  Temporary Removal of Antennas . If maintenance by the Association requires the temporary removal of any Antenna, the Association must provide the Owner and Occupant with ten (10) days written notice. The Owner and Occupant are then responsible for removing or relocating the Antenna before maintenance begins and replacing the Antenna when maintenance is completed. If the Antenna is not removed in the required time, the Association may remove it at the Owner and Occupant's expense. In such event, the Association is not liable for any damage to the Antenna or other property caused by the Association's removal.

•  Miscellaneous . These rules and regulations apply only to the installation, maintenance and use of Antennas and shall not be read to permit or otherwise govern the installation or maintenance of any other device. These regulations are severable and if any provision is determined to be invalid, the remaining provisions shall remain in full force and effect.
